If you are not patented, perform a basic preliminary patent search on the USPTO website (www.uspto.gov), or sites such as Free Patents Online (www.freepatentsonline.com) and Patent Storm(www.patentstorm.com) to ensure that your invention has not been previously-patented. Also, be sure to separately check for patents on the key individual components of your invention (even as they may be used in other industries, products and applications), as any prior patent(s) on a specific part of your invention may block your ability to patent a particular feature, should you decide to pursue a patent in the future. If you are in doubt of the patent status regarding any or all of your invention, you should consult a patent attorney or agent for a professional search and recommendation.
After completing these steps, many inventors are surprised to learn that their invention has been invented and patented before, and it may already be selling on the market. Please make sure that your invention will not raise a potential patent infringement issue, and that it is truly a new and unique idea.
